Welcome to Papillon HSEQ Systems. By purchasing, downloading, or accessing any products, templates, or services (“Products”), you agree to the following Terms & Conditions. Please read them carefully.

1. General Information

1.1 These Terms govern your use of the Papillon HSEQ Systems website, store and digital products.

1.2 “We”, “us”, and “our” refer to Papillon HSEQ Systems.

1.3 “You” and “your” refer to customers, website visitors, or any user accessing our content.

1.4 By purchasing from us, you confirm that you have read, understood, and agree to these Terms.

2. Use of Website

2.1 You must not use this website for unlawful, fraudulent, defamatory, or harmful purposes.

2.2 You must not attempt to copy, access, reverse engineer, or interfere with the website’s security.

2.3 We may update or vary these Terms at any time without notice.

3. Digital Purchases and Delivery

3.1 All Papillon HSEQ Systems digital products are digital downloads supplied in common file formats (PDF, Word, Excel, ZIP, etc.).

3.2 Delivery is automatic immediately after checkout through:

  • A secure download link on the confirmation page

  • A download link sent to your email address

3.3 If email delivery fails (spam filters, wrong email, etc.), it is your responsibility to contact us for re-sending access.

3.4 You are responsible for ensuring you have suitable software to open the files (e.g., Microsoft Word, PDF Reader).

3.5 We do not provide physical products, printed documents, or in-person services unless explicitly stated.

4. Licensing & Permitted Use End User Licence Agreement (EULA)

By purchasing any digital product, you are granted a non-exclusive, non-transferable, single-business licence (“Licence”).

4.1 You MAY:

  • Use the documents within your own business only

  • Edit, customise, and modify the templates to suit your operations

  • Use them for staff, sites, tenders, and compliance purposes

  • Use them repeatedly within the same ABN/entity

4.2 You MAY NOT:

  • Share, resell, repackage, or redistribute the documents

  • Upload them to public platforms, shared drives, or marketplaces

  • Provide them to clients as part of consulting or subcontracting services

  • Sell altered or modified versions of the templates

  • Claim the templates as your own intellectual property

4.3 Consultants, safety professionals & third-party resellers

If you wish to use our materials across multiple third-party clients, you must obtain a Commercial Consultant Licence.

Using a regular licence for multiple clients is strictly prohibited.

4.4 Breaches

Unauthorised sharing or resale may result in:

  • Immediate license termination

  • Civil action to recover damages

  • IP infringement claims under Australian Copyright Law

5. Pricing and Payment

5.1 All prices are in AUD unless stated otherwise.

5.2 We reserve the right to change prices at any time.

5.3 Payments are processed securely through trusted payment providers (Stripe, PayPal, etc.).

5.4 By completing payment, you confirm that your payment details are valid and authorised.

6. Refund Policy

Because our products are digital, instantly delivered, and non-returnable, we operate under a strict no-refund policy except where required under Australian Consumer Law (ACL).

6.1 No refunds will be issued for:

  • Change of mind

  • Purchasing the wrong product

  • Not reading the product description

  • Inability to use the files due to outdated or incompatible software

  • Download links not received because of incorrect email/spam filtering

  • Believing the digital product is a “service” after receiving a digital file

6.2 Refunds MAY be considered only if:

  • A file is corrupted or technically faulty and we cannot repair or replace it

  • You were charged multiple times for the same product

  • The product delivered is materially different to the description

6.3 Reverse engineering chargebacks / disputes

Fraudulent chargebacks (e.g., downloading the product and then attempting a refund through the bank) will result in:

  • Blocking access to all products

  • Revocation of licence

  • Submission of evidence to the payment processor

  • Potential debt recovery action for losses

  • Because digital files cannot be “returned”, all downloads are logged with IP, timestamp, and device information to verify receipt.

7. Australian Consumer Law (ACL)

Nothing in these Terms limits your rights under the ACL.

If a product is defective or not as described, we will repair, replace, or issue a remedy in accordance with consumer law.

8. Security and Fraud Prevention

8.1 We use secure payment gateways with automated fraud analysis.

8.2 Transactions flagged as high-risk may be cancelled, refunded, or held for verification.

8.3 We may deny service or access to anyone engaging in suspicious behaviour.

9. Limitation of Liability

9.1 Our templates are designed to assist with compliance but do not guarantee to legislative compliance or eliminate risk.

9.2 You are responsible for reviewing, customising, and applying the documents appropriately for your work, site, and legal obligations.

9.3 We are not liable for:

  • Misuse of documents

  • Failure to implement adequate safety systems

  • Business losses or reputational damage

  • Third-party actions

10. Copyright and Intellectual Property

10.1 All products are owned by Papillon HSEQ Systems.

10.2 No ownership or rights transfer to you upon purchase; only a licence to use is granted.

10.3 Violations may result in legal action.

11. Governing Law

These Terms are governed by the laws of Western Australia (WA).

Any disputes will be handled in WA courts or tribunals jurisdiction.
